| What steps have to be followed to authorise a waste management activity? |

- Determine which of the annexes of Decree
136/1999 (approving the general regulation on the
development of Law
3/1998 concerning the comprehensive intervention
of the environment administration and adaptation of
its annexes) classifies the activity to be developed.
The waste management activities are included in Group
10 of these annexes.
- Determine whether the activity requires environmental
impact evaluation. This case may include the waste management
activities of annexe I which are included in section
9 of the annexe of Decree
114/1988, concerning the evaluation of environmental
impact and also following Law 6/2001 of 8th May,
which modifies Legislative Royal Decree 1302/1986 of
28-6-1986 (RCL 1986\2113), concerning the Evaluation
of Environmental Impact.
- Draw up a technical project in line with the content
indicated in articles 60 (general data), 62 (specific
details of the project for waste management activities)
and 66 (common data) of Decree
136/1999.

| What documentation has to be presented in the application? |

| If the activity is from annexe I of Decree
136/1999, it is necessary to present the documentation
indicated in article 26 (application for environmental
authorisation). If the activity is in annexe II.1 or II.2,
the documentation must be presented that is indicated
in article 40 (application for environmental licence).

| In all cases, the documentation must be presented to the Town Hall of the municipality where the activity is to be set up.

| Once the activity has been authorised and when it is certified that all the requirements of authorisation or licence have been fulfilled, checked by the initial control of an ECA.

| Who has to draw up the technical project? |
 |
| A competent technician. The project must also be approved by the corresponding professional college.

| What are the procedures for authorising an extension, an authorised waste activity? |
 |
| It must be applied for with the Town Hall and must include
all existing installations and follow the same procedures
as for a new installation project.
