The waste producer and receiver must attach an explanatory report including the following information:
By the waste producing company:
- Description of the process causing the waste
- Description of the waste and its composition
- Annual amount of waste produced
- Updated analysis of the waste
By the waste receiver company:
- Description of the waste reception process
- Form of reception, waste storage and handling
- Replaced raw material
- Expected consumption of the waste and amount of raw material saved
- Measurements and controls of the additional effects of the use of the waste
You can follow the attached model in drawing up the report:
The Agència de Residus de Catalunya will examine the documentation, ask for complementary documentation, if necessary, and will issue a resolution declaring the waste a by-product.
Notes:
- An analysis of the waste must be presented if it is not identifiable by simple observation. The analytical determinations will be carried out according to the origin and nature of the waste and depending on the waste receiver process.
- The by-product declaration will remain in force for 5 years at most, but always subject to the contract between the companies. At the end of this time, to be able to continue to deal with the waste as a by-product, a new application must be made with a new contract and a new explanatory report.
- The management of waste as a by-product is exempt from the use of the Acceptance Sheet, the Consignment Note and using a transporter from the Waste transporter register.
- The company producing the waste will declare the management of this waste in their Annual industrial waste declaration as a BY-PRODUCT in the corresponding section.
- The receiver will declare this waste in their Annual industrial waste declaration in the RAW MATERIALS section, also indicating that it is a by-product.
