February 2005 saw the entry into effect
of RD 9/2005, of 14th January, by which
the list of potentially soil-polluting activities
and the criteria and standards for the declaration
of polluted soils are established.
Article 3 of RD 9/2005 states that, among
other things, operators who perform potentially
soil-polluting activities (APCs) must present
the preliminary situation report (PSR )

| What are Potentially
Soil Polluting Activities (APC’s)? |

| Royal Decree RD 9/2005 defines Potentially
Soil Polluting Activities (APC’s) as those industrial
or commercial activities that may pollute the soil whether
through their use of dangerous substances, or through
the generation of waste.
In accordance with Royal Decree RD 9/2005, Potentially
Soil Polluting Activities are considered to be:
- Those activities included in the epigraphs of the
Spanish Classification of Economic Activities (CNAE
93 revision 1) indicated in the annex of Royal Decree
RD 9/2005.
- Those activities that produce, use or store over 10
tonnes per year of one or various of the substances
included in Royal Decree RD 363/1995, of the 10th of
March, which passed the Ruling on the notification of
new substances and the classification, packaging and
labelling of dangerous substances.
- Those activities that hold stores of fuel for their
own use in accordance with Royal Decree RD 1523/1999,
of the 1st of October, with an average annual consumption
of over 300,000 l and a total storage volume of 50,000
l or above.
The list presented in this document is an interpretation
of that indicated in Appendix I of RD 9/2005, adapted
to the Catalan Classification of Economic Activities (CCAE
93 Rev1) and the five-digit activities classification

Report (IPS) |

| The Preliminary Situation
Report (IPS) is a report which must be presented by operators
performing potentially soil-polluting activities (APCs).
It can be prepared on the basis of the information produced
to comply with current legislation on waste and hazardous
substances and no special testing or analysis is necessary.
The main aim of the IPS is to gather relevant
information so that for sites where APCs are or have been
carried out, the likelihood of significant soil pollution
occurring can be evaluated. As such, those presenting
reports may attach any complementary information which
they consider useful for a better evaluation of the status
of the soil.
How to complete and submit the IPS
As indicated in RD 9/2005, the minimum scope
and content of the IPS are described in Annex II of the
aforementioned regulation.
However, to facilitate the preparation and presentation
of the IPS in Catalonia, there are two ways of completing
and submitting the IPS to the Agència de Residus
de Catalunya:
