| What is a public waste management service? |
|
| When an operation is declared as being a public service, it is reserved for the holding Administration, which must deal with the public service either directly or indirectly. The activities declared as being a public service are not performed in free competition with private initiative. |

| What public waste management services are there in Catalonia? |
|
| Law 6/93 declares that the treatment of the following hazardous wastes is a public service of the Generalitat, government of Catalonia: refrigerators and other apparatuses that contain chlorofluorocarbons, batteries, fluorescent tubes, mercury lamps and oils. A public service is also the disposal of hazardous waste refuse in external plants. |

| Are the public waste management services free? |

| The establishment of a public waste management service does not release the waste producer or holder from covering the derived costs, as they are performed under the principle of "whoever pollutes pays". |

| Are the public services managed directly by the Administration? |
|
| Public services, as is determined by the Law 6/93 itself, are preferably managed indirectly, that is, the concessionary company is selected. The Administration, in this case the Agència de Residus de Catalunya, is the body responsible on the one hand for establishing the technical, economic and administrative conditions under which it will give the service and, on the other hand, for controlling and pursuing the service. |

| How is the company chosen that is to operate the public service? |
|
| The public waste management services are adjudicated according to Law 13/1995 on Public Administration contracts, by the public tender procedure. All companies meeting the technical and economic requirements may present bids. According to pre-set criteria and the corresponding technical and legal reports, the contracting body chooses the best offer. |

| What obligations for waste producers are derived from the declaration of public service? |
|
| The producers or holders of waste the treatment of which is declared a public service are obliged to give them to the concessionary/ies under the established conditions and to satisfy the rates of the service when applicable. |

| Are the public waste management services Catalan? |
|
| Given that they are owned by the Generalitat, government of Catalonia, the public waste management services are given through Catalonia and must guarantee the service in this area. |
